Is PoSH training mandatory for all organisations?

Yes, in India, PoSH training is mandatory for all workplaces under Section 19 of the PoSH Act to ensure awareness and compliance. Organisations with 10 or more employees must additionally constitute an Internal Complaints Committee (ICC/IC) and provide specialised training for its members.

Who must attend PoSH training within an organisation?

All employees, including full-time staff, contractual workers, interns, trainees, and consultants, should undergo PoSH awareness training. In addition, managers and HR personnel require role-specific guidance, while ICC members must receive specialised capacity-building training to handle complaints, conduct inquiries, and ensure compliance.

What essential topics must be included in PoSH training for employees?

Effective PoSH training should cover the key definitions, various forms of sexual harassment, employee rights and responsibilities, the complaint inquiry and redressal process, the ICC’s role, and misconduct consequences to encourage a safe and respectful workplace culture. It should also incorporate real-life scenarios to help employees recognise and appropriately respond to inappropriate behaviour.

How can an employee report an incident of sexual harassment at the workplace?

An aggrieved woman can file a written complaint with their organisation’s ICC within three months of the incident or the last incident (in case of multiple incidents). For organisations with no ICC or if the complaint is against the management, the employee can also file a complaint with their jurisdiction’s Local Complaints Committee (LCC). Alternatively, the aggrieved woman can also register a complaint on https://shebox.wcd.gov.in/

Can PoSH training content be customised to match an organisation’s culture and requirements?

PoSH trainings need to mandatorily align with the provisions of the PoSH Act. Depending on the workforce structure, you could opt to conduct e-modules or instructor-led sessions specific to the white-collar and blue-collar workforces.
